Summary of the Competition Council Plenum Decision No. APD – 33 from 14.07.2017

On March 4, 2015, the Plenum of the Competition Council, taking into account the signs of the infringement of the competition legislation by the home appliance stores (Foxmart, Maximum, Alina Electronic, Bomba), regarding the exaggerated and concomitant increase in prices in prices for household appliances in February, 2015, through the Provision no. 7 ordered initiation of the investigation regarding the signs of violation of the provisions of the Competition Law no. 183 of 11.07.2012 by the household appliances stores managed by "Rolling International" LLC, "Maxiteh-ST" LLC, "AV Electronic" LLC, "BM Technotrade" LLC.

The investigation revealed that none of the 4 investigated enterprises held a dominant position in the market of household appliances in the territory of the Republic of Moldova in 2015.

With regard to the alleged actions of concurrent price increase, it was determined that there was no pre-established method, with reference to the price adjustment methods, the price adjustments graph, the price evolution used by the entreprises to modify the prices during the period 01.02.2015 - 28.02.2015 so that their actions have anticompetitive effects on the household appliance market.  Thus, the actions of the 4 investigated enterprises regarding the price increase during the period 01.02.2015-28.02.2015 for household appliances sold through the networks of stores administered by them are not concerted practices.

Thereby, due to Competition Council Plenum Decision No. APD-33, on 14 July 2017 it was ceased the investigation of the case, on the ground that during the investigation there were not found sufficient evidence related to the infringement of the provisions of the Competition Law no. 183 of 11.07.2012 which could substantiate the application of remedies or sanctions.
