On February 20, 2025, the new Regulation on the Notification Form, Examination Procedure, and Adoption of Decisions on State Aid entered into force.
The Regulation establishes the notification procedure, the simplified notification procedure, the notification forms, and the complaint form regarding alleged unlawful State aid or alleged misuse of State aid. Additionally, it regulates the investigation procedure, the assessment procedure for the compatibility of State aid with a normal competitive environment, the authorization, the adoption and publication of decisions on State aid, as well as the reporting, monitoring, and recovery of unlawful or misused State aid.
The scope of the Regulation is to establish the secondary legal framework for ensuring compliance with the obligation of State aid grantors and/or initiators to notify the Competition Council of any intention to grant State aid, for its authorization, reporting, recovery of unlawful or misused State aid, and for monitoring existing State aid.
Note: The new Regulation partially transposes the provisions of Council Regulation (EU) 2015/1589 as of 13 July 2015 and Commission Regulation (EC) No. 794/2004 as of 21 April 2004. It applies to State aid granted across all sectors of the national economy, except for the agricultural sector (as defined in Annex No. 1 to the Agreement on Agriculture, ratified by Law No. 218/2001 on the accession of the Republic of Moldova to the World Trade Organization), which is specified in Annex No. 1 to the Regulation.
