The Competition Council, in accordance with the provisions of Article 9 of Law No. 239/2008 on Transparency in the Decision-Making Process and Article 20(1)(a) of Law No. 100/2017 on Normative Acts, announces the initiation of the process for drafting the Regulation on State Aid for Support Measures in Favor of Banks in the Context of the Financial Crisis, which will ensure the transposition of EU legislation, as follows:

  • Commission Communication — The Recapitalization of Financial Institutions in the Current Financial Crisis: Limiting Aid to the Minimum Necessary and Safeguards Against Undue Distortions of Competition (CELEX: 52009XC0115(01));
  • Commission Communication on the Return to Viability and the Assessment of Restructuring Measures in the Financial Sector in the Current Crisis under the State Aid Rules (CELEX: 52009XC0819(03));
  • Commission Communication on the Treatment of Impaired Assets in the Community Banking Sector (CELEX: 52009XC0326(01));
  • Commission Communication on the Application, as from 1 January 2011, of State Aid Rules to Support Measures in Favor of Banks in the Context of the Financial Crisis (CELEX: 52010XC1207(04));
  • Commission Communication on the Application, as from 1 August 2013, of State Aid Rules to Support Measures in Favor of Banks in the Context of the Financial Crisis (CELEX: 52013XC0730(01)).

In order to ensure the implementation of the provisions of Law No. 139/2012 on State Aid and to fulfill the commitments undertaken by the Republic of Moldova under the Association Agreement between the Republic of Moldova, on the one hand, and the European Union, the European Atomic Energy Community, and their Member States, on the other hand, particularly in relation to the harmonization of national legislation with EU legislation in the field of State aid, it is necessary to draft the Regulation on State Aid for Support Measures in Favor of Banks in the Context of the Financial Crisis, which will be approved by a decision of the Plenum of the Competition Council.

Accordingly, to ensure transparency and enhance the efficiency of the drafting process for the Regulation on State Aid for Support Measures in Favor of Banks in the Context of the Financial Crisis, the Competition Council invites all relevant stakeholders to actively participate by submitting proposals in this regard.

Interested parties may submit their proposals and recommendations regarding the drafting of the aforementioned Regulation to the Competition Council, as well as electronically at office@competition.md.

Proposals should be submitted by April 4, 2025.
