In order to fulfill the commitments undertaken by the Republic of Moldova under the Association Agreement between the Republic of Moldova, on the one hand, and the European Union, the European Atomic Energy Community, and their Member States, on the other hand, particularly those related to the alignment of national legislation with the European Union acquis in the field of competition, it is necessary to develop the Guide on the Rules for Access to the Competition Council’s Investigation File in Anticompetitive Practices and Merger Control Cases.
The Guide will be approved by a Decision of the Plenum of the Competition Council for the implementation of Article 60 of the Competition Law No. 183/2012.

In accordance with Article 9 of Law No. 239/2008 on transparency in the decision-making process and Article 20 para. (1) letter a) of Law No. 100/2017 on normative acts, the Competition Council announces the initiative to elaborate the draft Guide on the Rules for Access to the Competition Council’s Investigation File.
This Guide will ensure the transposition of the Commission Notice on the rules for access to the Commission file in cases pursuant to Articles 81 and 82 of the EC Treaty, Articles 53, 54 and 57 of the EEA Agreement, and Council Regulation (EC) No. 139/2004 (2005/C 325/07).

To ensure the efficiency of the drafting process, we kindly request that opinions, proposals, and recommendations related to this initiative be submitted by 10 April 2025 to the following postal address:
