Center District Court rejected the entire action submitted by “Apa-Canal Chisinau” JSC to the Competition Council, therefore the Decision of the Competition Council which resolved the violation of the provisions of Law No 1103-XIV of 30.06.2000 on the protection of competition by “Apa-Canal Chisinau” JSC remains in force.
We note that in 2012, following an investigation, the Competition Council issued a decision that qualified the actions of “Apa-Canal Chisinau” JCS, manifested by imposing to sign project contract of reception and pre-treatment of wastewater with increased concentrations of pollutants and submission of additional payments for wastewater pretreatment as violation of the provisions of letter a) the art. 6 of Law No 1103-XIV of 30.06.2000 on the protection of competition.
According to these provisions are prohibited actions of economic agent with a market dominant position by imposing to counteragent the intentionally unfavorable terms or conditions which not covered by the contract.
Based on this Decision, Competition Council has issued for Apă-Canal Chișinău JSC a prescripriton on the removal of infringements.
