On 24.09.2018, there was received by the Competition Council a complaint from the Main Directorate of Health, Family and Social Protection of the Executive Committee of Gagauzia regarding the alleged anti-competitive practices of the company "Tetis International Co" SRL, manifested by the impeding public procurement proceedings by the company "Tetis International Co" SRL by continually contesting the results of the public procurement procedures at the National Agency for Solving Appeals, a fact that indicates at the signs of the violation of the provisions of art. 11 of the Competition Law no. 183 of 11.07.2012.

As a result of the investigation, the Competition Council found that the actions of "Tetis International Co" S.R.L. of possible abuse of a dominant position, manifested by the continuous challenge of the results of the public procurement procedures regarding the dry milk mixtures for children up to 12 months do not meet the constitutive elements of the violation provided in art. 11 of the Competition Law no. 183 of 11.07.2012. Thus, the violation of art. 11 of the Competition Law no. 183 of 11.07.2012 has not been ascertained.
