Summary decision of Competition Council Plenum No. CN -28 as of 03.06.2016

In fact, on December 17, 2015, by the Competition Council Plenum, there was disposed, based on the Decision no. 38, the initiation of an investigation, regarding the alleged anti-competitive behavior by the company „MOLDOVA ZAHĂR" S.R.L (ltd) to the detriment of the company „Südzucker Moldova" S.A.

During the investigation, the Competition Council,  has found sufficient evidence of violation of the article 19, para. (1) letter a) of the Competition Law no. 183 from 11.07.2012 by „MOLDOVA ZAHĂR". These violations were manifested through partial use of the trademark no. 23458 , belonging to „Südzucker Moldova".  Therefore, the Competition Council, has set a fine of  56070,10 MDL and has prescribed the termination, 2016 by „MOLDOVA ZAHĂR", of the act of unfair competition referred to in Art. 19 para. (1) letter a) of the Competition Law no. 183 of July 11, 2012 and, until September 01, the withdrawal from the market of its articles having the logo, similar to the brand, owned by „Südzucker Moldova" S.A.
