The Competition Council, in accordance with the provisions of Article 9 of Law No. 239/2008 on transparency in the decision-making process and Article 20(1)(a) of Law No. 100/2017 on normative acts, announces the initiation of the process for drafting the Regulation on the assessment of aid granted to beneficiaries providing services of general economic interest, which will ensure the transposition of the following EU legal acts:
- Commission Communication on the application of the European Union State aid rules to compensation granted for the provision of services of general economic interest (2012/C 8/02).
- Commission Communication — European Union framework for State aid in the form of public service compensation (2011) (2012/C 8/03).
- Commission Decision of 20 December 2011 on the application of Article 106(2) of the Treaty on the Functioning of the European Union to State aid in the form of public service compensation granted to certain undertakings entrusted with the operation of services of general economic interest.
In order to ensure the implementation of the provisions of Law No. 139/2012 on State Aid and to fulfil the commitments undertaken by the Republic of Moldova under the Association Agreement between the Republic of Moldova, on the one hand, and the European Union, the European Atomic Energy Community and their Member States, on the other hand — particularly with regard to the alignment of national legislation with the European Union acquis in the field of State aid — it is necessary to draft the Regulation on the assessment of aid granted to beneficiaries providing services of general economic interest, which will be approved by a decision of the Plenum of the Competition Council.
Accordingly, in order to ensure transparency and to streamline the process of drafting the Regulation on the assessment of aid granted to beneficiaries providing services of general economic interest, the Competition Council encourages the active involvement of all interested stakeholders by submitting proposals in this regard.
